Terms & Conditions
These are the terms on which we accept and complete an order. Placing an order — that is, paying the advance — means you accept them. They are written to be read, not to be survived.
1. Who you're dealing with
PortraitKart is a sole proprietorship owned by Jatin Tarai, trading in India.

In these terms, "we" and "us" mean PortraitKart; "you" means the person placing the order.
2. How an order is formed
- You send us a photograph and your requirements on WhatsApp.
- We quote a price and a timeline.
- You pay 50% in advance.
- The order is confirmed and the drawing begins.
A quote is not a contract until the advance is received. Until then either side may walk away with nothing owed. Once the advance is paid, the terms on this page and the Refund & Cancellation Policy apply to your order.
3. Prices
Prices are as published or as quoted to you on WhatsApp, in Indian Rupees, and are inclusive of delivery anywhere in India.

We may change published prices at any time. A change never applies to an order whose advance has already been paid — the price you were quoted is the price you pay.
4. The photograph you send us — your responsibility
By sending us a photograph, you confirm that:
- you own it or have the right to use it for this purpose; and
- you have the consent of any living person who is recognisable in it; and
- using it to make a portrait does not infringe anyone else's copyright or other rights.
Many photographs taken in a studio remain the copyright of the photographer, even when you paid for them. Please check before sending one.
If a third party makes a claim against us because of a photograph you supplied, you agree to indemnify us for the loss it causes.
5. Work we may decline
We may decline an order, before or after payment, where:
- the photograph is too low in quality — blurred, very small, badly lit — for us to do justice to it;
- the content is obscene, hateful or illegal;
- the image appears to infringe someone else's rights;
- we do not believe we can complete the work to our own standard.
If we decline after you have paid, we refund 100% of everything paid, within 7 working days. Declining an order is not a judgement of the photograph's meaning to you — often it simply lacks the detail a pencil needs.
6. Rights in the finished portrait
- The artist retains copyright in the drawing.
- You own the physical original we deliver to you. You may keep it, display it, photograph it, gift it or resell that physical piece.
- You may use images of it personally, including posting it on your own social media.
- PortraitKart may show your portrait in a portfolio, on the website or on social media only with your explicit permission, given in writing on WhatsApp. Permission can be withdrawn at any time. This matches section 3 of our Privacy Policy.
- Neither you nor we may use the portrait for commercial resale as a reproduced product — prints, merchandise, stock imagery — without the other's written agreement.
7. Delivery estimates
Timelines on the Shipping Policy page are working-day estimates given in good faith. They are estimates, not guarantees.
Courier delays, weather, strikes, local restrictions and force majeure events are outside our control. Where a delay is our fault, we will tell you as soon as we know, and we will redraw or refund as the situation requires.
8. Handmade variation
A hand-drawn portrait is an artist's interpretation, not a photocopy. Tone, texture and small details will differ from the photograph, and two portraits of the same photograph would differ from each other. That difference is what you are commissioning.
This is precisely why we send you a photograph of the finished drawing before you pay the balance — so that interpretation is something you approve, not something you discover on delivery.
9. Limitation of liability
To the extent permitted by law, our total liability in connection with an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including a missed occasion, disappointment or loss of profit.
Nothing in these terms limits liability that cannot lawfully be limited, and nothing here affects your statutory rights under the Consumer Protection Act, 2019.
10. Governing law
These terms are governed by the laws of India. The courts at [PENDING: city — Bhubaneswar? Confirm] have exclusive jurisdiction over any dispute arising from them.
We would far rather resolve a problem on WhatsApp than in a courtroom, and in practice we always try that first.
11. Contact
Full contact details are on the Contact page, and our Grievance Officer in section 10 of the Privacy Policy. Complaints are acknowledged within 48 hours and resolved within 30 days.
The short version
Send a photograph you have the right to use. Pay half to begin. See it finished before you pay the rest. If we cannot do it justice, we say so and give your money back.
